Sick Leave Guidance

Sick due to an employment conflict? We guide you through the entire process.

An employment conflict can literally make you sick. Stress, insomnia, burnout or overstrain. Your body is telling you it can't go on anymore.

And then a new process begins: sick leave reports, company doctor, reintegration, possibly the UWV. While you're already not feeling well, you have to struggle through a bureaucratic process.

LegalBacking takes you by the hand. We guide you through the entire sick leave process and ensure your rights are protected.

What do we do for you?

With sick leave guidance, we help you on all fronts. From the first sick report to possible procedures at the UWV. We know the rules and ensure your employer follows them too.

We guide you through meetings with the company doctor, check if the reintegration plan is correct and take over communication with your employer when needed.

This way you can focus on your recovery, while we take care of the rest.

Our guidance includes

  • Guidance with company doctor
  • Reintegration plan review
  • Communication with employer
  • UWV procedures
  • Expert opinion requests
  • Disability benefit support

Common situations

Burnout or overstrain

You've fallen sick with burnout or overstrain. The cause lies (partly) at work and you don't know how to reintegrate.

Situational incapacity

You can work, but not with this employer. The situation at work makes you sick, not the work itself - this is called situational incapacity.

Pressure during sick leave

Your employer puts pressure on you to return quickly or threatens with wage sanctions. You don't feel taken seriously.

Reintegration and your rights

When you're on sick leave, you have the right to continued payment of wages and your employer must make efforts for your reintegration. But not every employer follows the rules.

We check whether your employer is doing what they should. Is the reintegration plan correct? Are the company doctor's recommendations being followed? Is too much pressure being put on you?

If your employer doesn't follow the rules, we know what steps you can take.

UWV procedures

The UWV plays an important role in long-term sick leave. After two years, the UWV assesses whether you're entitled to disability benefits. But you may deal with the UWV earlier as well.

We know the procedures and know what to look out for. Whether it's an expert opinion, a wage sanction or a disability benefit application: we guide you through it.

The UWV process can be complex. With the right guidance, you avoid mistakes that could be costly later.

What we help with

  • Expert opinions
  • Appeals against decisions
  • Disability benefit applications
  • Employer wage sanctions

3

We guide you through the entire process: from company doctor to UWV, from employer to possible dismissal.
